What Is Civil Litigation?
Civil litigation includes any claim for financial compensation by an individual or a business. Civil actions also include other types of relief not involving criminal penalties. For example, divorce and child custody cases are types of civil litigation.
A civil claim or civil lawsuit for monetary compensation can involve real estate or personal property, as well as services — or even physical injury. When the harm involves a physical injury, the civil claim falls into the category called personal injury.
If a loss does not involve physical harm, the claim is not a personal injury case. However, many other kinds of civil actions also entitle individuals and businesses to financial compensation.
In Ohio, numerous laws protect residents from suffering harm caused by someone else’s conduct. In some cases, federal laws may also apply. Those laws include numerous provisions that protect consumers and entitle them to financial compensation when a violation of the law occurs.
You do not need to understand all the laws that protect you. You do not need to know what type of civil action may be involved. You just need to talk with us about the harm you suffered. We will listen to all your concerns, analyze the situation, and let you know what options you have for proceeding.
We help clients with all types of civil matters involving harm or loss caused by a business or another person’s conduct. One common type of civil action we handle involves a claim for violation or breach of a contract.
Breach of Contract Claims
Contracts affect almost every part of your life. Contracts define your legal rights and obligations in your work or business, the products you buy, and the services you use.
Every contract defines the duties and rights of both parties to the agreement, either expressly or by implication. More often than not, issues do not arise during performance of a contract. Everything goes as planned. Both parties are pleased with the result.
Sometimes, though, not everything goes as planned or as promised. A product or a service turns out to be different from what the contract promised. In those cases, you may be able to pursue a civil action to recover compensation for the damage or loss you suffered because of the other party’s contract violation. The legal term that applies to an action involving violation of the terms of a contract is breach of contract.
A breach of contract action arises when one of the parties to a legal agreement violates or does not honor the terms of the agreement. If the contract promised services or a product, and the services or product are not delivered as described, a breach of the contract occurred. If the person who promised payment did not pay for services or a product, a breach of the contract occurred.
